Welcome to Once Lost Treasure Now a Collectible Thriftzilla (“we,” “us,” “our”). These Terms & Conditions (“Terms”) apply to your use of our website, social media pages, and any services provided by our thrift business (together, the “Platform”). By accessing or using our Platform, placing an order, purchasing items, or submitting information to us, you agree to these Terms.

If you do not agree, please do not use our Platform or purchase from us.

1) Who We Are - Scope

  • We are a resale/thrift business selling previously owned (secondhand), donated, and/or pre-owned items.
  • Products may vary by location, season, inventory, and availability.
  • Store purchases and policies may differ by location (if you operate multiple pickup/consignment points). When a conflict arises, the in-store policy in effect at the time of purchase controls.

2) Eligibility and Responsible Use

You agree to use the Platform lawfully and only for permitted purposes, including:

  • Truthful information when contacting us (name, contact details, shipping/pickup info if applicable),
  • Not attempting to hack, scrape, interfere with, or disrupt the Platform or services,
  • Not using the Platform to purchase for fraudulent purposes.

3) Product Description - Condition of Items (Important)

Because items are secondhand:

  • All items are sold “as-is” unless stated otherwise in writing at the time of purchase.
  • We try to describe items accurately, but we do not guarantee that used items are free from wear, defects, prior repairs, minor imperfections, stains, fading, odors, missing parts, or age-related issues.
  • Photos and descriptions are for convenience; final condition is determined by the item you receive or the item you examine at pickup.

Final determination: If you notice a significant discrepancy between the listing/description and the received item, contact us promptly for review under the applicable refund/exchange section below.

4) Pricing, Payment, and Taxes

  • Prices may change without notice until an order is confirmed or payment is processed.
  • We may charge applicable sales tax (where required).
  • Payment is processed via our payment system (or in-store at the time of purchase). By submitting payment, you confirm you are authorized to use the payment method.

5) Returns, Exchanges, Refunds (Thrift Standard)

Because items are secondhand, our return/exchange rules are limited. Unless your receipt/invoice states a different policy:

  1. A) Returns
  • No returns for “change of mind” (size preference, color preference, “didn’t like it,” etc.).
  • Returns are considered only if:
    1. The item is materially different from what we described (e.g., wrong item, major listed feature missing), or
    2. There is an issue due to our error.
  1. B) Time Limit
  • If a return or exchange applies, you must notify us within 2 days of receiving the item / date of purchase.
  1. C) Condition Requirements
  • Returned items must be in the same condition you received them (no new damage, no excessive wear since purchase).
  • We may refuse refunds if items are altered or show additional damage.
  1. D) Refund Method
  • If approved, refunds are typically issued to the original payment method.
  • Refunds may exclude shipping/processing fees unless the error is ours.
  1. E) Exchanges
  • Exchanges may be offered at our discretion for items that qualify under the “material difference/our error” criteria, subject to inventory availability.

Note: If the item is a wearable (clothing/shoes), hygiene and sanitation considerations may affect return eligibility. We may deny returns for items that appear to have been worn or that have hygiene-related issues.

6) Sold, Donation Intake, and “As-Is” for Donations/Consignments

If you sell, donate, or consign items to us:

  • Items accepted by us are evaluated and may be assigned a resale value at our discretion.
  • We do not guarantee the sale of all accepted items.
  • Unless a written agreement states otherwise, we do not provide refunds related to accepted items.
  • If you receive store credit or cash for items, the amount offered is subject to inspection and may be adjusted if the condition differs from how it was described when submitted.

7) Promotions, Discounts, Loyalty/Rewards (If Offered)

  • Any rewards or discounts offered through our Platform are subject to eligibility and the terms available.
  • Promotions may end without notice unless required by law.

We may limit quantities, exclude certain items, and/or require redemption within stated timeframes.

8) Store Conduct and Safety

We may refuse service or remove individuals from our premises if we reasonably believe a person is:

  • causing harm or disrupting business,
  • engaging in unsafe behavior,
  • attempting fraud, theft, or policy evasion,
  • refusing staff instructions during store operations.

9) Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, or consequential damages.
  • Our total liability (if any) is limited to the amount you paid for the item/service that gave rise to the claim.
  • We are not responsible for:
    • defects from the normal wear of secondhand items,
    • user errors (wrong size ordered, misunderstanding listing details),
    • delays caused by shipping/carriers or factors beyond our control.

10) No Warranties

We provide products and services on an as-is / as-available basis. We disclaim warranties to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11) Intellectual Property

  • Content on our Platform (logos, text, photos, branding) is owned by us or used with permission.
  • You may not copy, download, distribute, or use our content for commercial purposes without our written consent.
  • You may not misrepresent that you are affiliated with or endorsed by Thriftzilla.

12) Links and Third-Party Sites / Social Media

  • Our Platform may include links to third-party websites or platforms.
  • We are not responsible for third-party content, accuracy, policies, or actions.
  • Social media interactions may be governed by the social media platform’s terms and privacy policies.

13) User Submissions (Messages, Reviews, Photos, Offers)

If you submit content (messages, photos, reviews, comments, suggestions):

    • You represent that you have the rights to provide that content.
    • You grant us a license to use, reproduce, display, and store your content to operate our business and respond to customers.
    • We may remove content that is offensive, unlawful, or violates these Terms.

14) Fraud, Chargebacks, and Disputes

  • We reserve the right to cancel or refuse transactions we believe involve fraud or abuse.
  • If a chargeback occurs, we may review the circumstances and request documentation.
  • We may cooperate with payment processors, law enforcement, or relevant authorities when required.

15) Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date at the top indicates when changes take effect. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

16) Governing Law - Venue

These Terms are governed by the laws of Rohrersville, Md (Maryland), without regard to conflict-of-law principles. Any dispute arising out of these Terms or your purchases will be handled in the courts located in Rohrersville, Md (Maryland) , unless required otherwise by law.
